但
could not have been是過去式
could not be是現在式

例如:
Mary could not have been the one who stole the money.(過去式)
Mary could not be the one who stole the money.(現在式)

   沒錯，因為could not have been foreseen 是在強調"過去無法預期"


現在完成式指的是，在過去的某一時間點開始，一直進行到現在才完成


因為"無法預期"這件事從過去就一直發生了，發生到現在為止，所以用現在完成式
